That&#039;s what attorneys for George Hitcho, Jr. are hoping to prove to a Northampton County judge.&lt;/p&gt;&lt;p&gt;

The defense also wants statements Hitcho allegedly made to another inmate suppressed.&lt;/p&gt;&lt;p&gt;

The defense says when police arrived at the scene of the Freemansburg shooting they illegally entered Hitcho&#039;s home but the District attorney says officers were simply following procedure.
&quot;It&#039;s routine procedure when they have a structure when someone just walked out of it with a gun and a shooting occurred they must go through it and do a cursory inspection for the safety of the police because we don&#039;t know if someone else is in there with a gun, whether he was the only guy or whatever,&quot; said District Attorney John Morganelli.&lt;/p&gt;&lt;p&gt;

Defense attorneys say officers searched Hitcho&#039;s house illegally.&lt;/p&gt;&lt;p&gt;

And what they found led to search warrants for items inside the house.&lt;/p&gt;&lt;p&gt;

In court Friday, police officers testified the Hitcho home was swarming with police, emergency personnel and residents right after the shooting.&lt;/p&gt;&lt;p&gt;

The officers told the judge there was concern for scene safety.&lt;/p&gt;&lt;p&gt;

Several testified that initially it was unclear how many people were involved, even though several officers say they saw Hitcho in handcuffs when they arrived.&lt;/p&gt;&lt;p&gt;

The defense is also hoping to suppress statements Hitcho allegedly made to an inmate shortly after he was arrested.&lt;/p&gt;&lt;p&gt;

The inmate is expected to testify Hitcho allegedly introduced himself as a cop-killer and said that he would be found insane at trail.&lt;/p&gt;&lt;p&gt;

The DA says he anticipates some kind of psychiatric or drug related defense at trial.&#160;&lt;/p&gt;&lt;p&gt;

&quot;Whatever was going through his head that day it was he knew what he was doing and he used deadly force and ended the life of a young cop,&quot; said Morganelli.&lt;/p&gt;&lt;p&gt;

A local hospital is touting a new kind of open heart surgery.&lt;/p&gt;&lt;p&gt;

Levers and switches will replace scalpels in a hybrid operating room that&#039;s one of the first on the east coast.&lt;/p&gt;&lt;p&gt;

The Food and Drug Administration approved transcatheter heart valves last November.&lt;/p&gt;&lt;p&gt;

Surgeons said the technology will make the Lehigh Valley Health Network one of the nation&#039;s leaders for heart valve replacement.&lt;/p&gt;&lt;p&gt;

It&#039;s a new innovative hybrid operating room at Lehigh Valley Hospital&#039;s location in Salisbury Twp., Lehigh Co. -- new lights, new machines, and a new way to repair a patients heart.&lt;/p&gt;&lt;p&gt;

&quot;Lehigh Valley Health Network is the first hospital in the region to provide this to the community,&quot; said Raymond Singer, chief of cardiothoracic surgery for the Lehigh Valley Health Network.&lt;/p&gt;&lt;p&gt;

Doctors will be performing transcatheter heart value replacement. The procedure has been performed in Europe for five to six years now and was approved by the FDA last November.&lt;/p&gt;&lt;p&gt;

The patients who will be receiving surgery at LVH will be high risk.&lt;/p&gt;&lt;p&gt;

&quot;This technology affords a less evasive approach and hopefully a safer approach and certainly an alternative to doing nothing for these high risk patients,&quot; said Singer.&lt;/p&gt;&lt;p&gt;

The valve replacement will start in the femoral artery and then go to the patient&#039;s heart.&lt;/p&gt;&lt;p&gt;

Doctors will use three dimensional x-rays and even technology that is used by military personal to land airplanes.&lt;/p&gt;&lt;p&gt;

&quot;The patients body is not being opened,&quot; added Singer. &quot;There&#039;s no open surgery here, so we need to have a way of looking three dimensionally.&quot;&lt;/p&gt;&lt;p&gt;

The center is scheduled to open in March and the first patient surgery should happen in April.&lt;/p&gt;&lt;p&gt;

&quot;Patients do not need to go to Philadelphia or New York,&quot; said Singer. &quot;They can stay right here in the Lehigh Valley and get this brand new state of the art technology.&quot;&lt;/p&gt;&lt;p&gt;

Surgeons said they will do more than just replacing heart values. After decades of being tax exempt, one community center is being told to pay up.&lt;/p&gt;&lt;p&gt;

In June 2011, the federal government started requiring all non-profit organizations to reapply for tax exemptions.&lt;/p&gt;&lt;p&gt;

When board members with Boyers Junction Community Center in Ruscombmanor Twp., Berks Co., did so, board member Carol Andreas said they were given unfortunate news by the county&#039;s board of assessment appeals.&lt;/p&gt;&lt;p&gt;

&quot;They assessed us at $187,000 and that we would have to start paying taxes in 2012,&quot; said Andreas.&lt;/p&gt;&lt;p&gt;

&quot;We were tax exempted for 50 years, or maybe 60 years now, since the 1950s,&quot; said David Hess, board president.&lt;/p&gt;&lt;p&gt;

&quot;It puts us in a bind because we don&#039;t have any money,&quot; said Brenda Degler, board treasurer.&lt;/p&gt;&lt;p&gt;

Degler said Boyers Junction is a private park with more than 250 members who use the park&#039;s facility.&lt;/p&gt;&lt;p&gt;

&quot;When we got our tax assessment in the mail, we had $400 in the checking account and that was to pay our electric for the rest of the year and get our newsletters written out for 2012 and postage,&quot; said Degler. &quot;And as of 2012 rolled around and everything was out, we had like $96 in our account.&quot;&lt;/p&gt;&lt;p&gt;

Board members said they have to pay about $6,000 in taxes because they charge a membership fee.&lt;/p&gt;&lt;p&gt;

To be exempted from federal taxes, nonprofit organizations have to meet certain criteria.&lt;/p&gt;&lt;p&gt;

The criteria include nonprofits having to be organized and operated exclusively for charitable, scientific, religious or public safety purposes.&lt;/p&gt;&lt;p&gt;

They also have to collect income and turn over the entire amount, less expenses, to organizations or individuals recognized as legitimate charities.&#160;&lt;/p&gt;&lt;p&gt;

Degler said board members filed an appeal in November, but were denied. They are planning to file again by July. If denied again, Degler said they will have to pay county taxes, Oley Valley School District taxes, as well as Ruscombmanor Township taxes.&lt;/p&gt;&lt;p&gt;

69 News reached out to the board of assessment appeals&#039; solicitor to ask how the community center was able to be tax exempt for decades, even though it was charging membership fees, but our calls were not returned.&lt;/p&gt;&lt;p&gt;

Boyers Junction board members said if they cannot pay their taxes, they fear the park will become the county&#039;s and sit idle.&lt;/p&gt;</span></li></ul>
